Introduction
With the following data protection declaration, we would like to inform you about which types of your personal data (hereinafter also referred to as “data”) we process, for what purposes and to what extent. This data protection declaration applies to all processing of personal data carried out by us, both in the context of the provision of our services and in particular on our websites, in mobile applications and within external online presences, such as our social media profiles (hereinafter collectively referred to as “online offer”).
The terms used are not gender-specific.

Consent
GDPR consent to self-test and feedback
Yes, I have read the data protection declaration (https://smart-moms.de/datenschutz) and agree that the data I have provided will be collected and stored electronically.
My data will only be used for the strictly intended purpose of evaluating the self-test, the feedback and for research purposes. After completion of the research project, the data collected will be deleted. Under no circumstances will data be transmitted to employers or health insurance companies or otherwise passed on to unauthorized third parties.
Before submitting the self-test and feedback forms, I agree to the data analysis in the sense of the SmartMoms (www.smart-moms.de) research project. When the data is transmitted, my IP address is the only personal connection saved. The data is saved so that my self-assessment result can be linked to my feedback, but is encrypted before the analysis.
I have been fully informed about the content, purpose and scope of the study (see the Participant Information section). Participation in the study is voluntary and can be terminated at any time without giving reasons. I have read the participant information with information on data processing carefully and I agree to the processing of my data as described therein.
I hereby agree to participate in the SmartMoms study. In this context, I agree that the web app may track my smartphone activity (see section Data transmission).

Participant Information
Dear interested parties of our SmartMOMS web app (www.smart-moms.de) and the associated self-tests and feedback survey,
SmartMoms was developed at the University Medical Center Hamburg-Eppendorf (UKE) and the Free University of Berlin (FU Berlin) to improve access to existing care services for mothers with postpartum depression. The smartphone application makes the often taboo subject of postpartum depression more transparent and can sensitize women to the disorder. The thematic focus of the website is on psychoeducation using a short video and information texts, the Edinburgh Depression Scale (EPDS) self-test for self-assessment of mood after birth, a feedback survey and the provision of information about various care services.
The use of smartphones and the Internet is widespread, opens up new possibilities and will continue to be of central importance in all areas of our society in the future. These new media bring with them a lot of potential for innovation and development. At the same time, many women with postpartum depression remain undetected and under-cared for. There is therefore an urgent need for effective prevention and treatment services. What is particularly relevant here are offers that can be used to address those affected early and with low thresholds in order to provide them with suitable care.

In order to reach as many people as possible as early as possible, SmartMoms was developed as a comprehensive support service tailored to the specific needs of women, which can be used directly on your own smartphone.
In order to check the effectiveness of the application and improve it if necessary, we address the feedback to all women of childbearing age (not just mothers). Participants in the survey agree that their information on the self-test and feedback may be stored and evaluated.
The University Hospital Hamburg-Eppendorf (UKE) and the Free University of Berlin (FU) are responsible for SmartMoms.
Procedure and data collection of the individual sub-steps
All data collected as part of the application is treated as strictly confidential. To protect this data, it is not passed on to (unauthorized) third parties. Using the information service does not leave any personal data on our servers, only a masked IP address (also known as pseudonymization). Participants only transmit a unique (unmasked) IP when submitting the self-test and feedback. The last two digits of the IP address are then coded by scientific staff, i.e. made unrecognizable, before another employee can continue with the evaluation. This step requires separate consent (GDPR consent) and is important in order to be able to assess the effectiveness of the application and, if necessary, improve it. This concept of pseudonymization is used as a standard procedure in science. All employees are subject to confidentiality.
Tracking and data within the application
When the website is visited for the first time, consent to data collection is requested via cookie opt-in. Here, participants can agree to statistical recording. Only then can the frequency and duration of smartphone use be recorded anonymously (tracking). For this purpose, so-called “app sessions” are recorded, among other things. This means that it is recorded how long end devices access the SmartMoms offer and which partial content is accessed. Optionally, statements can also be made about the participants’ whereabouts using location tracking (Google Analytics). Since the GPS data collected is distorted before it is saved, it is not possible to draw any conclusions about the exact whereabouts of the users. The actual position of the users is projected on the globe both in north/south and east/west directions and in height to another place in the world, while the actual location of the users remains secret. Only this anonymized location of the users is transferred to the study servers. More details are explained in the Google Analytics section. The aim of data recording during tracking is to be able to provide interesting feedback for participants and to be able to relate the data to other information from self-tests and feedback. As part of the tracking, the following activities are recorded on your smartphone.
Data transfer
Under no circumstances will data be transmitted to employers or health insurance companies or otherwise passed on to unauthorized third parties. All employees involved in the study are subject to confidentiality. All questionnaire and tracking data are collected directly in the app and transferred in encrypted form to a secure server of the UKE or FU Berlin. Before statistical evaluation, the complete data set is finally anonymized. The study data collected will be stored in anonymized form for at least ten years after completion of the study.
Scientific evaluations/publications
The data analysis is carried out by the participating universities in Hamburg and Berlin. The data collected will be used in an anonymized form in scientific presentations and publications. It is not possible and not necessary to trace the data back to individual people. Group comparisons are primarily used for the evaluation. The anonymous data is also uploaded to an online repository of the Open Science Framework so that other researchers can also use the anonymized data. This means that their information can promote research even better.
Revocation of participation including data deletion
Participants can withdraw their consent to data collection at any time at their own request, without giving reasons and without suffering any disadvantages. Consent to data collection as part of the digital offering (excluding self-tests and feedback) can be revoked at any time via opt ‑out (see Cookies section). If you withdraw your consent, no further data will be collected from you, e.g. via tracking. Your data will not be included in the final evaluation and will be deleted when data collection from all users has been completed. Before this, no access to the data is possible and therefore no traceability to you is possible. It is not possible to delete the information you provided during the screening within the app, as the information is stored completely anonymously until you consent to participate in the study and cannot be assigned to any person.
Legal basis
The legal basis for the processing of your personal data is your consent in accordance with Art. 6 Paragraph 1a) GDPR. Your participation is voluntary. We treat all collected data strictly confidentially and in accordance with the statutory data protection regulations. The transmission of social data in the context of research is permitted under Section 75 of the 10th Social Code for Social Administrative Procedures and Social Data Protection (SGB X), provided that the permission of the person concerned has been obtained.
Voluntary
The guidelines of the General Data Protection Regulation (GDPR) are adhered to. There are no risks associated with your participation. No data will be passed on to your employer, your health insurance company or other unauthorized third parties. There are no costs associated with using the web app or the self-test and feedback. The self-test and feedback require separate consent before data collection begins. Participation is voluntary and can be revoked at any time without giving reasons.
If consent to data collection for the purposes of self-testing and feedback is not given, the information offered by the web app can still be used.
Minors
Minors who are at least 16 years old can participate in the study without the consent of their legal guardians in accordance with the GDPR. Persons under the age of 16 are not allowed to participate in the study.
Verlosung
Teilnahmebedingungen für die Verlosung
Die Verlosung findet im Rahmen der Machbarkeitsstudie zur Evaluation der Wirksamkeit der Web-App statt. Veranstalter der Verlosung ist das UKE Hamburg und die FU Berlin.
Teilnahme
Die Teilnahme an der Verlosung erfolgt freiwillig und ausschließlich zu den hier aufgeführten Bedingungen. Mit der Anmeldung zur Teilnahme an der Verlosung erkennt die Teilnehmerin diese Bedingungen ausdrücklich an.
Eine Teilnahme an der Verlosung ist nur möglich und zulässig, wenn der Online-Fragebogen vollständig bearbeitet wurde.
Für die Teilnahme zur Verlosung ist die Angabe einer gültigen E‑Mail-Adresse erforderlich. Pro Teilnehmerin ist nur eine einmalige Anmeldung zulässig. Die mehrmalige Anmeldung zur Verlosung führt zum Ausschluss von der Verlosung.
Gewinn
Unter allen Teilnehmerinnen werden monatlich drei Wunschgutscheine in Höhe von je 25€, 50€ und 100€ verlost. Die monatliche Verlosung beginnt am 1. des Monats und endet am letzten Tag des Monats.
Die Gewinnerin wird unter der im Anmeldeformular angegebenen E‑Mail-Adresse innerhalb von 14 Tagen nach dem jeweiligen Monatssende benachrichtigt.
Wenn sich die benachrichtigte Gewinnerin innerhalb von 14 Tagen nach Benachrichtigung nicht bei der angegebenen Stelle meldet, verfällt deren Anspruch auf den Gewinn und es findet eine neue Losung statt.
Der Wunschgutschein wird als PDF an die Gewinnerin per Mail gesendet. Eine Barauszahlung, ein Umtausch des Preises sowie die Übertragung des Gewinns auf andere Personen sind nicht möglich.
Änderung, Unterbrechung und vorzeitige Beendigung des Gewinnspieles
Der Veranstalter behält sich das Recht der jederzeitigen Änderung, Unterbrechung oder Beendigung der Verlosung ohne Vorankündigung vor. Der Veranstalter wird von diesem Recht insbesondere Gebrauch machen, wenn die weitere Durchführung der Verlosung aus technischen oder rechtlichen Gründen nicht gewährleistet werden kann.
Haftung

Relevant Legal Bases
Below we share the legal basis of the General Data Protection Regulation (GDPR) on the basis of which we process personal data. Please note that in addition to the provisions of the GDPR, the national data protection regulations in your or our country of residence and domicile may apply. If more specific legal bases are relevant in individual cases, we will inform you of these in the data protection declaration.
- Consent (Article 6, Paragraph 1, Sentence 1 , Letter a. of GDPR) — The data subject has given consent to the processing of personal data concerning him or her for a specific purpose or for several specific purposes.
- Legitimate interests (Art. 6 para. 1 sentence 1 lit. f. GDPR) — Processing is necessary to protect the legitimate interests of the controller or of a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.
National data protection regulations in Germany: In addition to the data protection regulations of the General Data Protection Regulation, national regulations on data protection apply in Germany. This includes in particular the law to protect against misuse of personal data in data processing (Federal Data Protection Act — BDSG). The BDSG contains special regulations on the right to information, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes and transmission as well as automated decision-making in individual cases, including profiling . Furthermore, it regulates data processing for the purposes of the employment relationship (Section 26 BDSG), in particular with regard to the establishment, implementation or termination of employment relationships and the consent of employees. Furthermore, state data protection laws of the individual federal states may apply.
Security Measures
We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the technology, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons, to ensure a level of protection appropriate to the risk.
The measures include in particular ensuring the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as access, input, transfer, securing availability and separation. Furthermore, we have set up procedures that ensure the exercise of data subject rights, the deletion of data and reactions to threats to data. Furthermore, we take the protection of personal data into account when developing or selecting hardware, software and processes in accordance with the principle of data protection, through technology design and through data protection-friendly default settings.
Shortening the IP address: If it is possible for us or if saving the IP address is not necessary, we will shorten your IP address or have it shortened. In the case of shortening the IP address, also known as “IP masking ”, the last octet, i.e. the last two numbers of an IP address, are deleted (in this context, the IP address is an identifier assigned individually to an Internet connection by the online access provider). The shortening of the IP address is intended to prevent or significantly complicate the identification of a person based on their IP address.
Data Processing in Third Countries
If we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA)) or if the processing takes place in the context of the use of third-party services or the disclosure or transmission of data to other persons, bodies or companies, this will only be done in accordance with the legal requirements.
Subject to express consent or contractually or legally required transmission, we only process or have the data processed in third countries with a recognized level of data protection, contractual obligation through so-called standard protection clauses of the EU Commission, in the presence of certifications or binding internal data protection regulations (Art. 44 to 49 GDPR, information page of the EU Commission: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection_de ).
Use of Cookies
Cookies are text files that contain data from visited websites or domains and are stored by a browser on the user’s computer. A cookie is primarily used to store information about a user during or after their visit to an online service. The information stored can include, for example, the language settings on a website, the login status, a shopping cart or the location at which a video was watched. The term cookies also includes other technologies that perform the same functions as cookies (e.g. when user information is stored using pseudonymous online identifiers, also known as “user IDs”).
The following cookie types and functions are distinguished:
Temporary cookies (also: session cookies): Temporary cookies are deleted at the latest after a user has left an online offering and closed his browser.
Permanent cookies: Permanent cookies remain stored even after the browser is closed. For example, the login status can be saved or preferred content can be displayed directly when the user visits a website again. Likewise, the interests of users, which are used for reach measurement or marketing purposes, can be stored in such a cookie.
First-party cookies: First-party cookies are set by us ourselves.
Third-party cookies: Third-party cookies are mainly used by advertisers (so-called third parties) to process user information.
Necessary (also: essential or absolutely necessary) cookies: Cookies may be absolutely necessary for the operation of a website (e.g. to store logins or other user input or for security reasons).
Statistics, marketing and personalization cookies: Cookies are also generally used to measure reach and when the interests of a user or their behavior (e.g. viewing certain content, using functions, etc.) on individual websites are saved in a user profile. Such profiles are used to show users content that corresponds to their potential interests, for example. This process is also known as “tracking,” i.e. tracking the potential interests of users. If we use cookies or “tracking” technologies, we will inform you separately in our privacy policy or when obtaining consent.
Notes on legal basis: The legal basis on which we process your personal data using cookies depends on whether we ask you for consent. If this is the case and you consent to the use of cookies, the legal basis for processing your data is your declared consent. Otherwise, the data processed using cookies will be processed on the basis of our legitimate interests (e.g. in the commercial operation of our online serviceand its improvement) or when the use of cookies is necessary to fulfil our contractual obligations.
Storage period: Unless we provide you with explicit information about the storage period of permanent cookies (e.g. as part of a so-called cookie opt-in), please assume that the storage period can be up to two years.
General information on revocation and objection (opt-out): Depending on whether the processing is based on consent or legal permission, you have the option at any time to revoke your consent or to object to the processing of your data using cookie technologies (collectively referred to as ” opt ‑out”). Online Marketing
We process personal data for the purposes of online marketing, which may include in particular the marketing of advertising space or the presentation of advertising and other content (collectively referred to as “content”) based on the potential interests of users and the measurement of their effectiveness.
For these purposes, so-called user profiles are created and stored in a file (so-called “cookie”) or similar procedures are used by means of which the information about the user relevant to the presentation of the aforementioned content is stored. This information may include, for example, content viewed, websites visited, online networks used, but also communication partners and technical information such as the browser used, the computer system used and information on usage times. If users have consented to the collection of their location data, this can also be processed.
The IP addresses of the users are also stored. However, we use available IP masking procedures (i.e. pseudonymization by shortening the IP address) to protect users. In general, no clear user data (such as email addresses or names) is stored as part of the online marketing process, but rather pseudonyms. This means that neither we nor the providers of the online marketing process know the actual identity of the users, only the information stored in their profiles.
The information in the profiles is usually stored in cookies or using similar processes. These cookies can generally also be read later on other websites that use the same online marketing process and analyzed for the purposes of displaying content, as well as supplemented with further data and stored on the server of the online marketing process provider.
In exceptional cases, clear data can be assigned to profiles. This is the case if, for example, the users are members of a social network whose online marketing processes we use and the network links the users’ profiles with the aforementioned information. Please note that users can make additional agreements with the providers, e.g. by giving their consent during registration.
In principle, we only receive access to summarized information about the success of our advertisements. However, as part of so-called conversion measurements, we can check which of our online marketing processes have led to a so-called conversion, ie, for example, to the conclusion of a contract with us. The conversion measurement is used solely to analyze the success of our marketing measures.
Unless otherwise stated, please assume that cookies used will be stored for a period of two years.

Presences in Social Networks (social media)
We maintain online presences within social networks and process user data in this context in order to communicate with the users active there or to offer information about us.
We would like to point out that user data may be processed outside the European Union. This may result in risks for users because it could, for example, make it more difficult to enforce user rights.
Furthermore, the data of users within social networks is usually processed for market research and advertising purposes. For example, user profiles can be created based on the user’s usage behavior and the resulting interests. The user profiles can in turn be used, for example, to place advertisements within and outside the networks that presumably correspond to the user’s interests. For these purposes, cookies are usually stored on the user’s computers in which the user’s usage behavior and interests are stored. Furthermore, data can also be stored in the user profiles regardless of the devices used by the user (especially if the users are members of the respective platforms and are logged in to them).

In the case of requests for information and the assertion of data subject rights, we would also like to point out that these can be asserted most effectively with the providers. Only the providers have access to the user data and can take appropriate measures and provide information directly. If you still need help, you can contact us.
Facebook : We are jointly responsible with Facebook Ireland Ltd. for collecting (but not further processing) data from visitors to our Facebook page (so-called “ fan page ”). This data includes information about the types of content users view or interact with, or the actions they take (see “Things you and others do and provide” in the Facebook Data Policy: https://www.facebook.com/policy ), as well as information about the devices used by users (e.g. IP addresses, operating system, browser type, language settings, cookie data; see “Device Information” in the Facebook Data Policy Statement: https://www.facebook.com/policy ).
